Terms of Use

The terms of the Contractual Documents shall be binding upon you, the “User”, and govern your access to and use of the Digital Service. Use of the Digital Service includes but is not limited to downloading, accessing, browsing, and registering to use the Digital Service and the functions and services offered on or made available through the Digital Service.

By your use of the Digital Service, you unconditionally agree to be bound by the prevailing terms of the Contractual Documents as well as any policies and guidelines incorporated by reference (see References below). If you do not agree to be bound by the terms of the Contractual Documents, please do not use the Digital Service or any part thereof and exit the Digital Service immediately.
 
Any failure by us to exercise or enforce our rights under any of these Terms & Conditions shall not constitute a waiver of such right.

 

Definitions
 
In these Terms & Conditions:
 
a. “Company” means a company incorporated in Singapore or a corporation registered in Singapore.
 
b. “Contractual Documents” mean these Terms & Conditions and the Privacy Policy for the Digital Service.
 
c. “Digital Service” refers to the mobile application Parking@HDB developed by HDB, Materials and any related services (including but not limited to software, systems, notifications or otherwise).
 
d. “Firm” includes a sole proprietorship and a partnership registered in Singapore.
 
e. “Information” means any communications including information, material, feedback, suggestions (excluding personal data as defined in the Personal Data Protection Act 2012 (No. 26 of 2012).
 
f. “Materials” includes all information, content, source code, pages, software, programs, documents, pictures, images, photographs, graphics, trade and service marks, technology, design, data compilation, text, audio and videos in the Digital Service.
 
g. “Parking@HDB” means HDB’s Parking@HDB mobile app and HDB’s Parking@HDB website, as offered by HDB to its Users.
 
h. “Parties” mean HDB and the User collectively, and “Party” means any one of them.
 
i. “Singpass” means the Singapore Personal Access common password used to transact with various Government online services, details of which are found on the  Singpass website.
 
j. “Singpass ID” means the username that corresponds to the Singpass.
 
k. “Site” means all web pages contained in the Parking@HDB website, HDB e-Services and any file or any format which is accessed through a hyperlink, but does not include other unrelated web pages not hosted by HDB which are accessed through a hyperlink.
 
l. “T&Cs” or “Terms & Conditions” mean the Terms & Conditions herein.
 
m. "We", "our", "us" and “HDB” refers to the Housing & Development Board.
 
n. "You" and "User" includes the person who is currently accessing the Digital Service, regardless of whether Singpass is used, whether in his own name or for and on behalf of a Firm/Company. Where the person accesses the Digital Service for and on behalf of a Firm/Company, the Firm/Company shall be deemed to be a User as well.
 
Duties of the User
 
1. You agree as follows:
 
  • You will abide by these Terms & Conditions.
  • You will not use the Digital Service, your Singpass, or any other password and User ID for any unlawful purpose.
  • You will not alter or modify the Digital Service.
  • You will not transmit, distribute, post, communicate, or store information or other material on, to or through the Digital Service that:
  • is copyrighted, unless you are the copyright owner
  • infringes any intellectual property, privacy or publicity rights of others
  • is defamatory, threatening, obscene, harassing, harmful, or embarrassing to any other person or entity as determined by us in our sole discretion
  • is sexually explicit
  • contains viruses, Trojan horses, worms, time bombs, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or information
  • You will ensure that all information or data that you submit or permit or cause to be submitted on the Digital Service is complete, true and accurate. You are solely responsible for the contents of any information and data submitted. Where supporting documents are required, you should ensure all information submitted through the Digital Service is consistent with the supporting documents. Failure to do so may result in delay in processing or rejection of the submission. You may be liable for costs incurred due to false or incorrect information submitted.
  • You will promptly provide to us, upon request, any additional information which we may consider necessary in providing the Digital Service.
  • You will not interfere with or disrupt computer networks or systems connected to, supporting or hosting the Digital Service under any circumstances.
  • You will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Digital Service.
  • You will not take any action that imposes an unreasonable or disproportionately large load on the Digital Service.
  • You will not attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Digital Service.
  • You will not access data not intended for you or log into a server or account that you are not authorized to access.
  • You will not attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
  • You will not attempt to interfere with the Digital Service to any User, host or network, including without limitation, by way of submitting a virus to, or overloading, “flooding”, “spamming”, “mailbombing” or “crashing” the Site.
Privacy and Security
 
Disclosure of Data
 
2. We collect personal data from you to administer this Digital Service. By using the Digital Device, you also agree to the terms of the Privacy Policy for the Digital Service as may be amended from time to time.
 
3. We may, if necessary, share your personal data with other Government agencies, or with non-Government entities which have been authorized by us for the purpose of carrying out the Digital Service, so as to provide Digital Service to you in the most efficient and effective way, unless such data sharing is prohibited by law.
 
4. You may inform us in writing that you do not consent to such sharing of your personal data. Please note that withdrawal of consent could affect the quality or invoke the termination of the Digital Service delivered to you. For queries about HDB’s personal data sharing policy or to inform us that you do not consent to share your personal data, please contact DigitalParking@hdb.gov.sg.
 
Retention of Data
 
5. For your convenience, we may display to you data you had previously supplied to us. This will speed up the transaction and save you the trouble of repeating previous submissions. Should the data be inaccurate or out-of-date, please supply us with the latest data. We will retain the data only as necessary for the effective delivery of public services to you.
 
Security
 
6. You are fully responsible for the security or loss of your Singpass, Singpass ID and any other password and User ID assigned to you. This includes taking all necessary steps to keep your User ID(s) and password(s) confidential at all times, changing your password(s) periodically, and maintaining the confidentiality of your account information.
 
7. You are fully responsible for all activities, transactions and/ or enquiries made through the Digital Service with the use of your identification, Singpass, and/or other password(s), regardless of whether such activities, transactions or enquiries were made with your knowledge and authority. You must report to us immediately if you know or have reason to suspect that the security of your Singpass or any other password has been compromised or used by another person without your authority. Please note that HDB will never ask you for your Singpass or any other login password.
 
8. We reserve the right to deny or restrict access to the Digital Service to any particular person, block access from a particular Internet address to the Digital Service, or block your Singpass, Singpass ID or other password or User ID at any time without providing any reason and/or notification.
 
9. Where appropriate, we will use available technology to protect the security of communications made through the Digital Service, including those involving electronic storage and transmission of personal data. However, we do not accept liability for the security, authenticity, integrity, or confidentiality of any transaction and other communication made through the Digital Service, whether using Singpass or otherwise.
 
10. Internet communications are susceptible to interference or interception by third parties. We do not guarantee, represent or warrant that the Digital Service and the server are free from infection by computer viruses or other harmful elements.
 
Intellectual Property
 
11. All rights, title and interest in the Materials and the Digital Service are owned by, licensed to or controlled by us.  
 
12. Except as otherwise provided, no part of the Materials may be copied, modified, reproduced, reused, republished, reverse compiled, adapted, modified, altered, used to create a derivative work, displayed, broadcasted, uploaded, posted, transmitted, communicated in any form or by any means or otherwise distributed in any way for commercial or any other purpose without our prior written permission. Unauthorised use of the Materials may be a violation of our copyright and other intellectual property rights. 
 
13. To use the Materials or any part thereof, you must seek prior permission in writing, stating your identity, the content sought to be used, intent of use, manner of use and time frame of use. We reserve the right to refuse permission without stating any reason(s) and/or if we deem that the information you have submitted is insufficient.
 
14. You agree that all Information sent to us via the Digital Service is non-confidential and non-proprietary unless otherwise indicated by you. Such Information shall be deemed, and shall remain, our property. None of the Information shall be subject to any obligation of confidence on our part and you agree that we shall not be liable for any use of the Information by reproducing, publishing or otherwise using the Information in any way for any purpose.
 
15. Without limitation to the foregoing, we shall be entitled to reproduce, use, disclose and distribute any of the Information, including any ideas, concepts, inventions, techniques and know-how disclosed therein, for any purpose, including the developing, manufacturing and/or marketing of goods or services. If the applicable law does not recognise our ownership of such Information, you agree to grant us an exclusive, irrevocable, worldwide, royalty free licence to exploit the intellectual property rights, including all future copyright and all other rights of any nature (including rights now known or in the future created) in and to the Information and any revisions, additions and updates to the Information, or any derivative work(s) of the Information, whether existing now or in the future, for the full period of the intellectual property rights and all renewals and extensions, and with full rights to us to do anything with the Information, its revisions, additions or updates, or any derivative work(s) of the Information, as determined by us in our sole discretion.
 
Relying on Information
 
16. All Materials are provided for your general information only, do not constitute legal and/or other professional advice and should not be relied upon in that regard. The Materials may not include all information relating to the matters covered therein. While we have made reasonable efforts to ensure that the Materials are consistent with existing law, policies and practice, you shall conduct your own checks (which include but are not limited to seeking independent legal and/or other professional advice) to verify the accuracy, completeness, reliability, currency, adequacy and/or truth of the Materials and the applicability of the Materials to your particular circumstances before referring to, using and/or relying on any part of the Digital Service for any reason. We shall not be liable for any action taken or omission made in reliance on the Digital Service. To seek clarification about any of the Terms & Conditions or any part of the Digital Service, please feedback to DigitalParking@hdb.gov.sg.
 
17. We reserve all rights to, in our sole and absolute discretion, determine and amend from time to time the kind and type of information and services available on the Digital Service. The User bears all responsibility to check the Digital Service and/or with HDB directly regarding such changes and is deemed to have notice of all information and services available on the Digital Service and any such changes that may take place from time to time.
 
General Disclaimer and Limitation of Liability
 
18. The Digital Service and the Materials are provided on an ‘as is’ and ‘as available’ basis, without warranties of any kind (express, implied, statutory or otherwise arising from usage, custom or trade or by operation of law). We shall not be responsible for any errors or omissions, or for the results obtained from the use of the Digital Service and the Materials. Any use by you is solely and fully at your own risk.
 
19. To the fullest extent permitted by law, we do not represent or warrant and hereby disclaim any representation or warranty of any kind (express, implied, statutory or otherwise arising from usage, custom or trade or by operation of law) to you or any third party:
 
i. as to the truth, accuracy, correctness, veracity, fullness, adequacy, originality, completeness, reasonableness, reliability, satisfactory quality, currency, timeliness, non-infringement of third party rights, title, merchantability and fitness for any purpose of the Digital Service and the Materials
 
ii. regarding the use or the results of the use of the Digital Service and the Materials in terms of their correctness, accuracy, completeness or reliability, or otherwise
 
iii. that the Digital Service and the Materials will meet your needs or requirements
 
iv. that any service, software or information provided on the Digital Service and the Materials will be uninterrupted, timely, accurate, reliable, secure, fault- free or error free, or that defects will be corrected
 
v. that any information transmitted by you by e-mail or other means through or to us or anyone will be accurately received or secure
 
vi. as to compliance with or non-infringement of any third party intellectual property or proprietary rights
 
vii. that the Digital Service and the Materials are free from any virus or other malicious, destructive or corrupting code, programme or macro.
 
20. Using the Digital Service and the Materials means you acknowledge, accept, and assume all risks inherent in Internet transactions and will not hold us liable under any circumstances for any claim or demand (for damages, losses, expenses, etc.) which you may have or be exposed to as a result of you assuming such risks.
 
21. To the fullest extent permitted by law, we shall not be liable to you or any third party and expressly disclaim liability for any loss, damage, expense or cost, including but not limited to direct, indirect, punitive, special, consequential or incidental damages, loss of income, revenue, profits, goodwill, business, business contracts or business opportunities, anticipated savings, economic loss, lost or damaged data, or damage to your computer, software, router, telephone, device or other property, which may result, directly or indirectly, from:
 
i. anything done or omitted to be done in relation to the Digital Service and the Materials
 
ii. reference to, usage of and/or reliance on any statement, opinion, representation or information in the Digital Service and the Materials
 
iii. usage of or access to any other website linked to the Digital Service and the Materials
 
iv. any delay in operation or transmission, communication failure, Internet access difficulties or malfunctions in equipment or software or any inability to use or loss of access to this Digital Service and the Materials, Singpass or any other password, howsoever caused
 
v. the conduct or the views of any person who accesses or uses the User’s Singpass or any other password and/or accesses or uses the Digital Service
 
vi. any errors, omissions, inaccuracy or incompleteness in the Digital Service and the Materials or in the transmission of the Digital Service and the Materials
 
vii. any decision made or action taken by you or any third party in reliance upon the Digital Service and the Materials even if HDB or its employees are advised of the possibility of such losses, damages and/ or expenses
 
viii. any virus or malware, system, server or connection failure, error, omission, interruption
 
ix. your downloading, submission and/or uploading of information through the Digital Service.
 
22. While every care is taken by us in providing the Digital Service and the Materials, no warranty is given that access to the Digital Service and the Materials will be provided uninterrupted or free from error or that any identified defect will be corrected and we disclaim all liability for any direct, incidental or consequential damage or loss that may result from such interruptions or errors or defects, including but not limited to:
 
i. any loss of, or any inability to retrieve, any data or information however caused as a result of any interruption, suspension or termination of service
 
ii. any inaccuracy in the information presented, used or transmitted through the Digital Service and the Materials

 

Access to the Digital Service

23. The accessibility and operation of the Digital Service relies on technologies outside our control. Due to the inherent defects of electronic distribution, you acknowledge that there may be errors, delays, omissions, interruption, breach of security, corruption, unavailability of access in connection with or inaccuracies in the Digital Service. We do not guarantee, represent or warrant continuous accessibility or uninterrupted operation of the Digital Service at any time, including during the time you access any information or perform any online transactions/services, whether using Singpass, other password(s), or otherwise.

24. To use the Digital Service, the User will require a device that meets the system and compatibility requirements for the Digital Service (as may be subject to change from time to time), internet access and a compatible software platform. The User’s ability to use the Digital Service and the performance of the Digital Service may be affected by these factors. The Digital Service may not be available for use on all devices and HDB does not warrant that all or any features or functionalities of the Digital Service will work on any particular device.
 
25. To use the Digital Service, the User will require Internet connectivity and the appropriate telecommunication links. The User acknowledges that the terms of agreement with the User’s respective mobile network provider will continue to apply when using the Digital Service. As a result, the User may be charged by the said mobile network provider for access to network connection services for the duration of the connection while accessing the Digital Service or any such third party charges as may arise. The User accepts all responsibility for any such charges that arise.
 
26. There may be updates to the Digital Service and the User is responsible for installing updates as prompted by the User’s device or the relevant app store. The User may not be able to access or use the Digital Service unless and until the updates are installed.
 
27. We reserve the right to, in our sole and absolute discretion, deny, suspend or terminate a User’s access to the Digital Service without notice and without assigning any reason for the same.
 
Consent to Access Functions of your Device
 
28. Use of the Digital Service shall constitute your consent to the access by the Digital Service of certain functions of your device such as push notifications and/or any collection of data from you in relation to the Digital Service or as may be reasonably required by the Digital Service.
 
Hyperlinks
 
29. We reserve the right to provide links to other unrelated websites including private sector websites. Under no circumstances are links to such websites intended to mean that they are endorsed or approved by us, nor shall we be considered to be associated or affiliated in any manner with any trade or service marks, logos, insignia or other devices used or appearing on websites to which the Digital Service is linked.
 
30. We are not responsible or liable for the availability or contents of any other website linked to/from the Digital Service. Access to any such site is at your own risk. You shall not hold us responsible or liable, directly or indirectly, for any damage or loss arising from use of and/or access to information or material provided or made available in such websites.
 
31. By caching or creating a link to or frame of the Digital Service, you do so at your own risk. Such linking to or framing of the Digital Service constitute acceptance of the Terms & Conditions. This is deemed to be the case even after revised Terms & Conditions have been posted. If you do not accept these Terms & Conditions, you must discontinue any linking to or framing of the Digital Service.
 
32. We reserve the right to object to or disable any link to or frame of the Digital Service. We also reserve the right to change any URL, including the URL of the Digital Service, without notification.
 
33. You shall not link any page in this Digital Service to any other website containing any prohibited material under the Infocomm Media Development Authority’s Internet Code of Practice, including but not limited to the following:
 
i. inappropriate, racist, profane, defamatory, obscene, indecent or unlawful topics, names, material or information
 
ii. material or information that violates any intellectual property, proprietary, privacy, publicity or other legal rights
 
iii. material that promotes terrorism and that is harmful to public interest, public morality, public order, public security, national harmony, or is otherwise unlawful
 
Fees
 
34. We reserve the right to introduce and revise any fees for use of the Digital Service from time to time. We are not responsible for any fees charged by any other service and/or website that is not provided by us.
 
35. You shall also ensure that payments (if any) are made to us in accordance with the terms and conditions of the various HDB e-Services, which may be provided via the HDB InfoWeb.

 

Indemnity

36. At all times, you will indemnify, keep us indemnified, and hold us harmless against any mishaps caused by or resulting from:
 
i. your use of the Digital Service (including access and/or any use of third party software and/or services)
 
ii. use by any other person of the Digital Service, using your username and/or login password
 
iii. your breach of these Terms & Conditions and/or any applicable law, whether or not written
 
iv. breach by any other person of these Terms & Conditions and/or any applicable law, whether or not written, where such person was able to use the Digital Service by using your username and/or login password
 
v. any action taken or omitted to be taken in good faith by us pursuant to any information or instruction given by you
 
37. The mishaps include:
 
  • Losses (including direct, indirect, incidental, and/or consequential losses)
  • Damages (including general special, and/or punitive damages)
  • Injuries
  • Claims, demands, costs, expenses, fees (including all legal fees, such as that between solicitor and client, on a full indemnity basis whether or not incurred in respect of any real, anticipated, or threatened legal proceedings)

38. The above indemnity shall continue to be valid even after you have ceased using the Digital Service.

Variation

39. We may revise these Terms & Conditions at any time, with or without notice to you, and without liability. You must visit these terms every time you access the Digital Service and review the then current Terms & Conditions because they are binding on you. Once you use the Digital Service after amendments to the Terms & Conditions have been made, you shall be deemed to have accepted and agreed to such amendments and the amended Terms & Conditions in force at the date of your use of the Digital Service. Thus, if you do not agree to any amendments to these Terms & Conditions, you must not proceed and should exit immediately.
 
40. In addition to these Terms & Conditions, you shall also be bound by:
 
i. all other terms and conditions of our HDB e-Services when using them
 
ii. our prevailing policies, procedures and/or practices, whether published or otherwise
 
41. These T&Cs shall not affect the applicability of the Terms of Use of the HDB InfoWeb and the Privacy Statement of the HDB InfoWeb. In the event of any inconsistency between these T&Cs and the Terms of Use of the HDB InfoWeb and the Privacy Statement of the HDB InfoWeb, these T&Cs shall prevail.
 
42. We may, at our discretion, without giving prior notice and without liability, at any time suspend the operations of the Digital Service or all or any part of the services contained in the Digital Service for any period of time, whether for the purposes of updating, upgrading, system maintenance, or otherwise.
 
43. We reserve all rights to, in our sole and absolute discretion and without liability and without notice, update, supplement, amend, and/or change these T&Cs and any such update, supplement, and/or amendment shall form part of these T&Cs. Consequently, we may in our sole discretion add to, delete, withdraw, vary, discontinue, suspend, fully or partially, any Materials, features and/or all other forms of content that form part of the Digital Service (including all services available within it) at any time, with or without prior notice to you, and without liability. The User’s continued use of the Digital Service following any such revision shall constitute his/her agreement to be bound by these T&Cs as amended.

  • Teletext
  • Facsimile
  • Normal mail
  • Registered mail
  • By hand
  • SMS messages
  • Push notifications
  • Wireless Application Protocol-enabled facilities

45. Documents shall be deemed to be duly served if sent by any of the above ways to an address (electronic or otherwise) provided by you in the Digital Service.

Invalidity

46. If any of the terms and conditions of these Terms & Conditions are determined to be illegal, invalid or otherwise unenforceable, that term and condition shall be deemed severed from the Terms & Conditions and shall not affect the validity and enforceability of any of the remaining terms and conditions.

 

Applicable Law and Jurisdiction

47. Use of the Digital Service, Singpass, Singpass ID, any other password or User ID, and these Terms & Conditions are governed by and construed in accordance with the laws of Singapore. Any claim or dispute relating to use of the Digital Service, Singpass, Singpass ID, any other password or User ID, and these Terms & Conditions will be heard by the Singapore Courts.
 
48. The Parties agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore and these T&Cs shall be governed by and construed in accordance with the laws of the Republic of Singapore, including but not limited to the provisions of the Evidence Act (Chapter 97) and the Electronic Transactions Act (Chapter 88).
 
Use of Open Data
 
49. The use of datasets that agencies including us publish to the public free-of-charge (Open Data) will be governed by the Singapore Open Data Licence.
 
Third Party Software/Services
 
50. The Digital Service and/or Site may require, enable or facilitate access to or use of software and/or services of a third party (e.g Google Play Store or Apple App Store).
 
51. You are deemed to have notice of any third party terms and agree to be bound by all obligations in the third party terms that are applicable to you when obtaining and/or using the Digital Service.
 
52. You will unconditionally enter into an agreement with the third party and be legally bound by all obligations in the third party terms of use if the third party require you to enter into an agreement directly with the third party.
 
53. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any term of this Agreement. The reference to a person, in this clause includes any individual, company, corporation, firm, partnership, joint venture, association, organisation, trust, state or agency of a state (in each case, whether or not having separate legal personality).

54. The headings in these T&Cs are inserted for ease of reference only and shall not affect the construction or interpretation of these T&Cs.
