Terms and Conditions - Estate Agent Toolkit

Please read all the Terms and Conditions carefully.

 

1.         APPLICATION FOR THE ESTATE AGENT TOOLKIT

1.1       The application for the Estate Agent Toolkit must be submitted by the Key Executive Officer (KEO) of the licensed estate agent (“estate agent”). The KEO is the person who is responsible for the proper administration and overall management of the business as well as the supervision of the estate agent’s salesperson(s). In this regard, you may refer to the Public Register in the Council for Estate Agencies website at www.cea.gov.sg for a list of the registered KEOs.

1.2       The application form for the Estate Agent Toolkit and application form for Interbank GIRO may be downloaded from the HDB InfoWEB at www.hdb.gov.sg. The completed application forms shall be mailed to HDB Resale Department (HDB Hub 480 Lorong 6 Toa Payoh Singapore 310480), enclosing all the relevant fees. HDB reserves the right, in its sole discretion, to reject any application for the Estate Agent Toolkit and/ or the application form for Interbank GIRO.

1.3       HDB will determine the starting date and ending date of the Estate Agent Toolkit and it will remain in force unless earlier terminated in accordance with the provisions of the T&Cs.

1.4       By submitting the application form for the Estate Agent Toolkit or by accessing in any way the Estate Agent Toolkit, the estate agent agrees to be bound by all the terms set out in these T&Cs.

1.5       Reference to “T&Cs” herein shall also include all the terms and conditions relating to HDB’s Estate Agent Toolkit as may be found on HDB’s website at www.hdb.gov.sg and application form for the Estate Agent Toolkit.  HDB reserves the right to amend the T&Cs without giving any prior notice and any changes will take effect immediately. All users are advised to regularly check HDB’s website to be kept informed of all changes as and when they are made. 

1.6       Reference to users shall mean the KEO and authorised persons of the estate agent.

 

2.         FACILITIES PROVIDED BY THE ESTATE AGENT TOOLKIT

2.1       The following facilities will be provided by the Estate Agent Toolkit.

            (i) Submission of Resale Application and Request for Value

            (ii) Viewing Status of Resale Applications and Request for Value submitted by the salespersons

            (iii) Payment by GIRO

            (iv) Viewing reports such as the Daily Usage Report, GIRO Deduction Report and User Access Report

            (v) Updating Estate Agent Information

2.2       Salespersons from estate agents that have signed up for the Estate Agent Toolkit will be able to submit their resale applications and Request for Value via HDB’s e-Service (Online Submission of Resale Applications and Request for Value). The transactions submitted via this e-Service will be consolidated in a summary report in the Estate Agent Toolkit.

2.3       HDB reserves the right to amend, modify, withdraw or suspend in any way any of the facilities set out in clause 2.1 at any time without giving any prior notice

2.4       HDB will not be responsible for any loss or damage suffered by the estate agent or any other party due to any inaccuracy, omission or error in any of the information provided by the Estate Agent Toolkit, for whatever reasons.

 

3.         RIGHTS OF ACCESS TO ESTATE AGENT TOOLKIT

3.1       Once the Estate Agent Toolkit is made available by HDB for use by the estate agent, the KEO of the estate agent may logon to the Estate Agent Toolkit and nominate authorised users (“users”) to perform the following functions:

            (i) Submit Resale Application and Request for Value

            (ii) View Status of Resale Application and Request for Value submitted by their salespersons

            (iii) Make GIRO payments

            (iv) View Daily Usage Report, GIRO Deduction Report and User Access Report

            (v) Update Estate Agent Information

3.2       The KEO must ensure that only authorised users are allowed to access the Estate Agent Toolkit at any time.

3.3       The use of the Estate Agent Toolkit is to facilitate the submission of resale applications and Request for Value and cannot be used for any other purpose except with the prior written consent from HDB.

3.4       If there is a change in the KEO or contact details of the estate agent, the estate agent shall inform HDB within three working days from the date of change.

3.5       HDB reserves the right, in its absolute discretion, to deny or restrict access to the Estate Agent Toolkit to any particular estate agent, or salespersons of the estate agent without giving any reasons whatsoever.

3.6       HDB also reserves the right, in its absolute discretion, to block access from any particular internet address to the Estate Agent Toolkit, at any time, without giving any reasons whatsoever.

 

4.0       RESPONSIBILITIES OF USERS   

4.1       The users of the Estate Agent Toolkit must ensure that:

(i) any information obtained from the Estate Agent Toolkit may only be used for the purpose of processing and completing the relevant resale transaction. The information cannot be used in any other way including but not limited to using the information for any commercial purpose or profit, or copying, reproducing, duplicating or selling the information, except with the prior written approval of the HDB. HDB’s approval (if applicable), may be given subject to such terms and conditions as HDB in its absolute discretion deems fit, including the imposition of a fee;  

(ii) they log in personally using their own Corppass. They must not facilitate any unauthorised access by allowing another person to use their Corppass to access the Estate Agent Toolkit. The KEO and the authorised users of the estate agent shall be liable for all damage and losses incurred by HDB or any other party, whether directly or indirectly, as a result of a breach of this clause;

(iii) all information provided by the users via the Estate Agent Toolkit must be complete and accurate, failing which HDB may not give access or may restrict, revoke or limit access to the Estate Agent Toolkit; and

(iv) they are supported by a service provider and technical equipment which can facilitate and support their use of the Estate Agent Toolkit.  

 

5.         INTELLECTUAL PROPERTY RIGHTS

5.1       All intellectual property rights, including but not limited to copyright and trade marks, contained in, relating to or in connection with the Estate Agent Toolkit (including text, graphic, logos, icons, sound recordings and software) are owned by HDB. No materials provided through the Estate Agent Toolkit, including text, graphics, compilation, computer programs, code and/ or software may be produced, modified, adapted, distributed, published, displayed, uploaded, broadcast, posted, transmitted or hyperlinked in any manner and in any form without the prior express written approval of HDB.

 

6.         MODE OF PAYMENT

6.1       The estate agent must:

(i) ensure that there are sufficient funds in their bank account before the GIRO deduction date;

(ii) in a situation where there is any failed GIRO attempt, make payment to HDB within three working days from HDB’s written request or verbal notification to do so. HDB reserves the right in its absolute discretion to impose interest or charge a fee for any late payment.  The bank may also charge a fee for any unsuccessful GIRO deduction due to insufficient funds.

6.2       Users may check the fees payable for submission of the resale application and Request for Value on the HDB InfoWEB at www.hdb.gov.sg. The IBG deduction date is on a daily basis. If the first deduction is unsuccessful (due to insufficient funds in the bank account), an email notification will be sent to the estate agent’s registered last known email address (as updated by the estate agent in the Estate Agent Toolkit) informing of the failed deduction and to top up the bank account within 10 days from HDB’s email notification. HDB reserves the right to use any other means it deems appropriate to relay the information of the first failed deduction and in such event, the top up must also be made within 10 days from being informed by HDB to do so. If there is a failure in the second attempt at deduction, access to the Estate Agent Toolkit will be suspended. 

6.3       In the event the estate agent’s account is suspended, no resale application or Request for Value can be submitted via the Estate Agent Toolkit and the salespersons will not be able to submit any applications via HDB’s e-Service (Online Submission of Resale Applications and Request for Value).    

6.4       HDB reserves the right to vary the fees payable without giving any prior notice. In the event of any changes in the fees, all users will be notified of the changes via their most recent contact particulars furnished to HDB or the changes may be updated on HDB’s website at www.hdb.gov.sg.

6.5       Without prejudice to the clauses set out above, if there is a failure to pay the fees within the timeframes stipulated, HDB may suspend access to the Estate Agent Toolkit until payment in full of all outstanding fees, including any interest or late payment fee (where applicable), is received by HDB. HDB reserves the right to terminate access to the Estate Agent Toolkit if the outstanding fees, including any interest or late payment fee (where applicable), is not paid within three working days.

 

7.         DEREGISTRATION OF ESTATE AGENT TOOLKIT

7.1       The application for deregistration of the Estate Agent Toolkit shall be submitted by the KEO of the estate agent. The KEO may email the request to MyRequest@HDB

7.2       HDB will require (an estimated) seven working days to process the deregistration.

7.3       The estate agent shall make payment to HDB of all outstanding moneys which are due and payable to HDB, including any interest or late payment fee (where applicable), and HDB reserves the right to recover any outstanding moneys owed to HDB by the estate agent and to determine when deregistration will take effect from.

7.4       Where full payment for the resale application/ Request for Value/ estate agent annual fees have been made, there shall be no refund (whether fully or partially) of any fees paid upon termination of the Estate Agent Toolkit.

7.5       Without prejudice to the other clauses in these T&Cs, if the payment for the resale application and Request for Value is not made, HDB reserves the right in its absolute discretion to revoke the estate agent’s access to the Estate Agent Toolkit.

 

8.         LIMITATIONS OF THE ESTATE AGENT TOOLKIT

8.1       While HDB will use its best effort to ensure that the information provided by the Estate Agent Toolkit is accurate and provided in a timely manner, HDB does not warrant that the information provided by the Estate Agent Toolkit will be accurate, error free and timely at all times.

8.2       In the event of any inconsistency or ambiguity in any information provided by the Estate Agent Toolkit, HDB’s decision on the matter shall be final and conclusive.

8.3       HDB will not be liable to the users or to any other party if the information provided by the Estate Agent Toolkit is not accurate, error free or provided in a timely manner, for whatever reasons.

8.4       HDB will not be liable to the users or to any other party for any loss, damage, costs or expenses incurred by them (whether directly or indirectly) in the use of the Estate Agent Toolkit, for any reason whatsoever, including but not limited to any loss or damage suffered as a result of relying on any information provided by the Estate Agent Toolkit or where the information is not provided in a timely manner.

 

9.         VARIATION OF TERMS

9.1       HDB reserves the right to delete, insert, alter or amend any of the T&Cs set out herein and the same will take effect immediately without giving any prior written notice to the users.

 

10.       INDEMNITY

10.1     All users of this Estate Agent Toolkit shall indemnify HDB in full for all losses, damages, costs and expenses incurred by HDB arising directly or indirectly from their breach of any of these T&Cs.

 

11.       CONTRACTS (RIGHTS OF THIRD PARTIES) ACT 2000

11.1     These T&C’s may only be enforced by the parties to these Terms and Conditions and may not be enforced by any person or entity who is not a party to it.      

 

12.       USE/ SHARING OF INFORMATION

12.1     All information given to HDB via the Estate Agent Toolkit may be used by HDB to administer its public housing programmes and services. HDB may use or share such data in an aggregated form with any other party which HDB may in its absolute discretion decide.
