If the divorce occurs after the requisite occupation period has been fulfilled, the lessee may be allowed to sell the flat provided he/she meets all eligibility conditions for resale.
The lessee must produce the following documents:

|
Court Order (if any). |
An official English translation of the above documents by a sworn interpreter of the Supreme Court or Subordinate Courts is required if the documents are not in any of the four official languages.
FAQ
I am going through a divorce proceeding with my wife. Can I sell my matrimonial flat in the open market if we have met all eligibility conditions for resale?
Yes. But you may have to engage your own private solicitor to act for you in the conveyancing for the sale of the flat.
