Deliver Vacant Possession

Sellers must deliver vacant possession of the flat to the buyers on resale completion. They are not allowed to continue to stay in the flat after resale completion, as they are no longer the lessees of the flat.

Lessees who sublet their flat without HDB's prior approval are committing an infringement under the Housing & Development Act. HDB will take appropriate action, which includes the recovery of the flat.

FAQ

Can I enter into a tenancy agreement to rent the whole flat from my buyers after the resale completion?

No. This is strictly prohibited. Under Section 56(1)(h) of the Housing & Development Act, the Board may compulsorily acquire the flat if the owner sublets the whole flat without HDB's consent. You are advised to make the necessary accommodation arrangements once you have proceeded to sell your flat.
